Jennifer C Osborn Perez, responsible for the website, hereinafter RESPONSIBLE, makes this document available to users, with which it intends to comply with the obligations established in Law 34/2002, of July 11, on Information Services. the Information Society and Electronic Commerce (LSSICE), as well as informing all users of the website regarding the conditions of use.

Any person who accesses this website assumes the role of user, committing to strict observance and compliance with the provisions set forth herein, as well as any other legal provision that may be applicable.

Jennifer C Osborn Perez reserves the right to modify any type of information that may appear on the website, without any obligation to notify or inform users of said obligations, with publication on the Jennifer C Osborn Perez website being understood as sufficient.

Scope of Application, Definitions

(1) These General Terms and Conditions (GTC) apply to the business relationship between Bilingualexplorer (“we”) and you (“you”) at the time of the contract’s conclusion. Any differing terms and conditions of customers shall not be valid unless expressly agreed to in writing by Bilingualexplorer.

(2) On the bilingualexplorer.com website (“Website”), we offer Spanish language learning resources and services, including free information and materials, as well as paid online language courses and materials (collectively referred to as “Service” or “Services”). The term “Materials” includes all learning materials provided by Bilingual explorer, whether within or outside an online Spanish language course, and regardless of whether they are offered for free or for a fee.

User Account, Contract Conclusion, Contract Languages

(1) To use Bilingual Explorer´s Services, you must create a user account. For this purpose, you need to provide your first and last name and email address in the online registration form, set a password of your choice, and agree to the GTC. After submitting the registration form, you will receive a confirmation email from Bilingual Explorer to activate your user account.

(2) By creating the user account, you confirm that you are at least 18 years old and capable of entering into legally binding contracts. You agree not to create a user account for anyone else without Bilingualexplorer´s permission, to provide accurate and complete information during account creation, and to update your information if it changes while using the account.

(3) To participate in a paid online language course, you must place an order with Bilingual Explorer  through your user account. By clicking the order button and submitting the order, you make a binding contract offer. However, the contract offer can only be submitted and transmitted if you accept these GTC by checking a box and including them in your offer.

(4) The contract for the online language course between Bilingualexplorer and you is concluded when Bilingualexplorer sends you a separate email containing the declaration of acceptance (order confirmation). This email includes the text of the contract (comprising GTC and order confirmation) on a durable medium. Bilingualexplorer will store the contract text in accordance with data protection laws.

Rights of Use and Restrictions

(1) Bilingualexplorer owns all copyright exploitation rights to the Materials, including content, text, images, software, audio and video files, and documentation.

(2) Bilingualexplorer grants you a non-exclusive, non-transferable, non-sublicensable, worldwide right to use the Materials solely for private and non-commercial purposes.

(3) You may not communicate, publish, distribute, sell, rent, sublicense, reproduce, or exploit the Materials or any other copyrighted work of Bilingualexplorer without Bilingualexplorer’s explicit prior written consent.

(4) Making video and/or audio recordings of online language courses and publicly reproducing or distributing them is prohibited.

Use of the Service, Data Protection, Service Failure

(1) Your access to and use of the Website and Services are personal to you and non-transferable to others. You may only use the Website and Services for lawful purposes.

(2) You are responsible for keeping your Bilingualexplorer user account, username, and password confidential and must not disclose them to third parties. You are responsible for all activities related to your user account. Notify Bilingualexplorer immediately of any unauthorized use of your account.

(3) Bilingualexplorer is not obliged to keep a log of your user account or any data stored through the user account or Services.

(4) Interruptions to the Website and Services may occur for reasons such as updates, maintenance, repairs, or other measures necessary to maintain functionality.

Online Spanish Course

(1) If you book an online Spanish course, Bilingualexplorer will provide you with live online lessons with native Spanish teachers based on your booking. Details of your online language courses are available in your user account under “My Profile.”

(2) Bilingualexplorer offers online language courses based on “course credit basis” redeemed through “credits,” either already included in the order or purchased separately.

Purchased credits are non-refundable and valid for one year from purchase, unless otherwise specified on the checkout page. However, they can only be redeemed during an upfront payment for an online language course.

(3) To use online Spanish courses, you must use specified third-party video conferencing software, which you must procure at your own expense.

(4) You can cancel an online language course without giving reasons. Different rules apply depending on the timing of the cancellation. If the cancellation is done at least 24 hours before the scheduled course, you may receive credit in order to re-schedule the class. If the cancellation is done less than 24 hours before the scheduled course, bilingualexplorer reserves the right to close the course, with the respective credits being used up and not refunded o reused.

(5) Bilingualexplorer may cancel an online language course before the scheduled start time for reasons like the teacher’s illness, with the respective credits being retained by you.

(6) If you connect  more than 10 minutes late for a class, the teacher may close the course, with the respective credits being used up and not refunded.

Fees and Payments for Online Spanish Courses

(1) When booking an online Spanish course, you are obligated to pay the agreed-upon fees as specified in the order.

(2) The current prices of offered language courses can be found on the registration pages and other sections of the Website. Bilingualexplorer’s fees are final prices.

(3) Bilingualexplorer may change fees/prices once per calendar year to reflect cost increases associated with providing the Services. Customers will be informed of such changes at least six weeks in advance.

(4) At the moment, Bilingualexplorer accepts payments only through credit card.

Term, Termination

(1) The term of an online Spanish course begins as specified in the order confirmation.

(2) Upfront payment online language courses have a specified contract period and cannot be terminated unless stated otherwise on the checkout page. Such courses do not automatically renew.

(3) Online Spanish Courses with a free trial 15 minute class are only available to new customers.

(4) Termination for good cause may occur if contractual obligations are violated or other specified reasons exist.

Liability

Bilingualexplorer’s liability for damages is limited in certain cases, such as for slightly negligent breach of material obligations. However, this limitation does not apply in cases of mandatory statutory liability, intent, gross negligence, or injury to life, body, or health.

Privacy Policy

Your use of our Website and processing of personal data are subject to our privacy policy.

Your Special Duties

(1) The opinions and messages you post do not represent or reflect the views of Bilingualexplorer or its employees. Bilingualexplorer is not liable for the content of any messages you send to other customers on Bilingualexplorer.

You agree not to post any of the following content:

Content that violates the rights of third parties, especially their copyrights or data protection rights.

Obscene, pornographic, violence-glorifying, or trivializing content that endangers children and youth.

Defamatory, insulting, abusive, or threatening messages against other customers or third parties.

Content that is racist, anti-Semitic, homophobic, transphobic, discriminatory, offensive to human dignity, or immoral.

(2) You further agree to refrain from the following actions:

Distributing electronic content, including viruses, worms, or Trojan horses, that could cause damage to Bilingualexplorer’s computer systems. You must not publish URLs or links to websites containing harmful content.

Generating excessive electronic traffic, such as sending unsolicited commercial emails, junk emails, or other unsolicited communications (spamming).

Using any mechanism, software, or script that interferes with the functionality or accessibility of the Website or modifies, deletes, or overwrites content created and maintained by Bilingualexplorer.

(3) You also agree:

Not to photograph other participating clients or language teachers during an online language course or make audio and/or video recordings of them, or share them publicly.

Not to insult, defame, discriminate against, or threaten other participating clients or language teachers during online language courses based on reasons like racism, anti-Semitism, homophobia, transphobia, or any other discriminatory behavior.

Compensation

You agree to indemnify Bilingualexplorer against any damages resulting from your negligent or intentional breach of the GTC.

Changes to the GTC

Bilingualexplorer reserves the right to change these GTC for future effect, such as due to legal changes or to improve Website or Service functionality. Unreasonable changes, especially to essential parts of the contract, are excluded. Bilingualexplorer will notify you of any changes to these GTC in text form (email is sufficient) at least six (6) weeks prior to their intended effective date, using your last known email address. If you disagree with the changes to the GTC, you have the right to object or terminate your contract before the changes take effect. If you do not object or terminate, it will be assumed that you agree with the new GTC. Bilingualexplorer will inform you about this and its consequences in the notification of the changes to the GTC.

If you object to the application of the changed GTC, Bilingualexplorer may cancel the contract and your user account by giving you two (2) weeks’ notice.

Dispute Settlement Procedure
